These Terms & Conditions govern your use of thewindmillnursery.co.uk and any purchase you make from us. By using this website or placing an order you agree to them. Please read them alongside the policies they link to.

2. Acceptance

By accessing this website, placing an order or using our services you agree to these terms. If you do not agree with any part of them, please do not use the website.

3. Products and availability

We aim to keep descriptions, images, pricing and availability accurate. We may modify product information, discontinue products, correct errors and refuse or cancel orders as set out in Order Acceptance & Stock Availability.

Images are illustrative and natural material variation is normal — see Product Information & Materials.

4. Prices and payment

All prices are shown and charged in pounds sterling (GBP). The price displayed on the product page is the total price for that item, and no additional taxes or duties are added at checkout for UK deliveries. The full amount payable is shown at checkout before you confirm.

We may change prices at any time; the price that applies is the one displayed when you place your order. Pricing errors are handled under Pricing, Tax & Currency. Accepted payment methods and security are covered in Payments & Security.

5. Orders and contract formation

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not accept your offer; a contract is formed when we send a dispatch confirmation for the item. We may refuse or cancel an order for the reasons listed in Order Acceptance & Stock Availability, and we refund in full where payment has already been taken.

6. Delivery

Delivery is governed by our Shipping & Delivery and Delivery Access & Large Items policies. Delivery estimates are estimates. Risk in the goods passes to you on delivery; ownership passes when we have received payment in full.

7. Cancellation, returns and refunds

Your statutory right to cancel, our 30-day returns window and the refund process are set out in Cancellation & Cooling-Off Rights and Returns & Refunds. Nothing in these terms restricts those rights.

8. Faulty goods and guarantee

Goods must be of satisfactory quality, fit for purpose and as described under the Consumer Rights Act 2015. Our voluntary 12-month guarantee is set out in Warranty & Guarantee and adds to, rather than replaces, those rights.

9. Intellectual property

The text, images, graphics, logos and design of this website are owned by The Windmill Nursery or its licensors and are protected by intellectual property law. You may not copy, reproduce or distribute them without our prior written permission. Product photography supplied by manufacturers remains the property of its owner.

10. Acceptable use

You agree not to use the website for any unlawful purpose, attempt unauthorised access to our systems, interfere with its operation, submit false information, or engage in fraudulent activity. We may suspend access where we reasonably believe this clause has been breached.

11. Liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill.

We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights as a consumer.

We are not liable for indirect or consequential loss, loss of profit, or business losses, as the products we sell are supplied for domestic and private use.

12. Events outside our control

We are not liable for delay or failure caused by events beyond our reasonable control. Where such an event materially affects your order, we will contact you and you may cancel and receive a full refund for anything not yet delivered.

13. Privacy

Personal data is handled as described in our Privacy Policy, Cookie Policy and Marketing Communications & Consent policy.

14. Third-party links

This website may link to third-party sites. We are not responsible for their content or practices, and access is at your own risk.

15. Complaints

If something goes wrong, our Complaints & Dispute Resolution policy explains how to raise it and the timescales we work to.

16. Changes to these terms

We may update these terms. The version that applies to your order is the version published when you placed it; changes are not applied retrospectively to orders already accepted.

17. Governing law and jurisdiction

These terms are governed by the law of England and Wales. If you are a consumer, you benefit from any mandatory protections of the law of the part of the United Kingdom in which you live, and you may bring proceedings in the courts of that part — England and Wales, Scotland, or Northern Ireland.
